1. Acceptance of Terms
By accessing or using Skyward Techno's website, mobile applications, products, or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Skyward Techno provides enterprise software products (CRM, ERP), mobile applications for iOS and Android, and professional services (custom development, implementation, integration, support). Specific terms for each product or service may be outlined in separate agreements.
3. Mobile Application Terms
The following terms apply specifically to our mobile applications (Skyward CRM and Skyward ERP apps):
- License: We grant you a limited, non-exclusive, non-transferable, revocable license to use our mobile applications on devices you own or control, subject to these Terms. The apps are licensed, not sold.
- App store terms: You acknowledge that the apps are subject to the applicable terms and policies of the platform through which you download them (Apple App Store, Google Play Store). In the event of a conflict between these Terms and the app store terms, our Terms apply to the extent permitted.
- Device permissions: Our apps may request access to device features including location services, camera, local storage, and push notifications. You can manage these permissions through your device settings. Certain features may not function without the required permissions.
- Updates: We may release updates to our apps from time to time for security, performance, or feature improvements. We recommend installing updates promptly. Continued use of outdated versions is at your own risk.
4. Location Services and Data
Our mobile applications include features that use your device's location data. By enabling location-based features, you consent to the collection and processing of your location data as described in our Privacy Policy.
- Location data may be used for field service tracking, attendance verification, fleet management, route optimization, shipment tracking, and location-based analytics
- Organization administrators may enable or configure location features on behalf of their users through the admin console
- You can revoke location permissions at any time through your device settings (iOS: Settings > Privacy & Security > Location Services; Android: Settings > Apps > Permissions)
- Disabling location permissions may limit the functionality of features that rely on location data
5. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, including activity on mobile devices where you are signed in. You agree to notify us immediately of any unauthorized use of your account.
6. Intellectual Property
All content, trademarks, software, and intellectual property in our website and mobile applications are owned by Skyward Techno. You may not reproduce, distribute, reverse-engineer, or create derivative works without our prior written consent.
7. Acceptable Use
When using our services and mobile applications, you agree not to:
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of our applications
- Use the applications for unauthorized tracking, surveillance, or monitoring of individuals
- Attempt to circumvent security measures, access controls, or usage limits
- Use the services in violation of any applicable laws, including laws regarding privacy and location data
- Interfere with or disrupt the integrity or performance of our services
8. Limitation of Liability
Skyward Techno shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to:
- Inaccuracies in GPS or location data due to device hardware limitations, environmental conditions, or network availability
- Decisions made based on location data or analytics provided by our applications
- Service interruptions or data loss resulting from network connectivity issues on mobile devices
- Unauthorized access to your account due to failure to maintain credential security
9. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your data — including location data collected through our mobile applications. Please review the Privacy Policy carefully.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or a notice on our website and mobile applications. Continued use of our services after changes constitutes acceptance of the new terms.
12. Termination
Either party may terminate the use of services at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your license to use our mobile applications is revoked and you must delete the apps from your devices. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall remain in effect.
